Terms of Service

These Terms of Service (“Terms”) are an agreement between you and WebWizard Co. (“WebWizard Tools”, “we”, “us”) and govern your use of the WebWizard Tools website and image tools (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. The Service

WebWizard Tools provides browser-based image tools, including background removal, image upscaling, and image compression. These tools run in your browser: your images are processed on your own device and are not uploaded to our servers.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you use it on behalf of an organization, you represent that you’re authorized to bind that organization to these Terms.

3. Accounts

Some features require an account. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. You may sign in with email and password or, where offered, with Google.

4. Plans, limits & payment

• The Service offers a free tier and paid plans. Each plan has monthly usage limits that reset on a recurring basis. Current plans and prices are shown on our pricing page; prices are in U.S. dollars (USD) unless stated otherwise.
• Paid plans are billed in advance on a recurring basis through our third-party payment provider. By subscribing, you authorize us (via that provider) to charge the applicable fees, including any taxes, until you cancel.
• You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep paid access until then. Except where required by law, fees already paid are non-refundable.
• We may change plans, limits, or prices. We’ll give reasonable notice of price changes, and any change applies from your next billing period.

5. Your images & content

You retain all rights to the images and content you process. Because processing happens in your browser, we don’t receive, store, or claim any rights to your images. You are solely responsible for the images you use and you represent that you have the necessary rights to process them. The output files are yours, and you may use them for personal or commercial purposes.

6. Acceptable use

You agree not to:

• use the Service for unlawful, infringing, harmful, or deceptive content, or to process images you don’t have the rights to;
• create content that is illegal where you are, including non-consensual, exploitative, or abusive imagery;
• attempt to bypass plan limits, rate limits, authentication, or other security measures;
• resell, sublicense, or provide the Service to third parties as your own without our permission;
• scrape, overload, reverse-engineer, or otherwise interfere with the Service or its infrastructure;
• use automated means to abuse the Service or to create large numbers of accounts.

We may suspend or terminate accounts that violate these rules.

7. Intellectual property

The Service itself — including our software, website, branding, and content (excluding your images) — is owned by WebWizard Co. or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, or distribute our software or branding without permission.

8. Availability & changes

We work to keep the Service available but don’t guarantee it will be uninterrupted or error-free. We may add, change, suspend, or discontinue features at any time. We may also update these Terms; for material changes we’ll update the date above and take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.

9. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Automated image processing produces varying results depending on the input; we don’t warrant any specific output quality.

10. Limitation of liability

To the maximum extent permitted by law, WebWizard Co. and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 50. Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless WebWizard Co. from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required for legal or security reasons. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability, indemnification) will survive.

13. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of Chandigarh, India, except where mandatory consumer-protection laws in your country of residence provide otherwise.
